Eligibility, account, and authority
Any email-verified adult may hold an account as an individual. A person may also act for a professional activity or organization only when authorized to do so.
Signup does not request country or professional status. Account access is personal, details must be accurate, and credentials must not be shared.
- The exact account Terms and Acceptable Use Policy must be accepted, and receipt of the durable legal copy must be confirmed separately.
- The Privacy Notice is acknowledged, not accepted as consent.
- Google sign-in, where offered, is an identity method only and does not replace the same legal confirmation.
- The service is intended only for adults.
Free beta and separate product admission
The public beta is offered for EUR 0. No payment card is requested, no paid plan is created, and there is no automatic paid conversion or renewal.
Before first product use, a separate admission step records the minimum self-declared country, adulthood, and end-use facts and requires one current approved jurisdiction record.
- The target market is the European Union and European Economic Area plus the United States, but a country is not enabled merely because it is in that target.
- Missing, stale, pending, blocked, contradictory, or mismatched jurisdiction evidence produces a truthful waitlist result.
- IP geolocation, an email domain, and the existence of an account are not admission authority.
- No business or audience category is collected for ordinary SaaS admission.
Beta service, customer content, and support
The service is pre-release and may change, be interrupted, or be withdrawn. Support is asynchronous and provided on a reasonable-efforts basis without an SLA or 24/7 commitment.
Users retain their rights in content they provide and authorize only the processing needed to operate the requested service, subject to the Privacy Notice and any applicable Data Processing Addendum.
- Do not provide content without the necessary rights and lawful basis.
- Users remain responsible for suitability testing and appropriate copies of important data.
- The Acceptable Use Policy forms part of these terms.
- No uptime, response, restoration, resolution, certification, or future-feature commitment is made.
Consumers, cancellation, and withdrawal
Where mandatory consumer law applies, a consumer has the applicable 14-day withdrawal right. Merely entering the hosted beta does not by itself state that this right has been lost.
A user may stop using the beta and may use the account export and deletion controls. A withdrawal notice may also be sent to legal@gutmask.xyz; statutory consequences remain governed by mandatory law.
- The provider supplies contractual confirmation on a durable medium.
- Optional analytics or marketing choices are separate and are not a condition of cancellation or withdrawal.
- Nothing in these terms removes mandatory conformity, refund, repair, termination, or damage remedies.
Suspension, termination, and changes
Access may be restricted or suspended proportionately for security, abuse, unlawful use, sanctions or export restrictions, or material breach. Where safe and lawful, the user receives the reason and a way to contest the decision.
Material contract changes require notice and a new affirmative acceptance before the changed terms govern continued product use.
- The user may terminate by stopping use and requesting account deletion.
- Security or legal emergencies may require immediate protective action.
- Termination does not erase records that must lawfully be retained for security, legal claims, or compliance.
- Discontinuation is not an automatic conversion to a paid service.
Law, beta limitations, and notices
The draft governing-law basis is Will be added later and, for non-consumers, the competent courts at the provider's Spanish establishment. Mandatory consumer law and the consumer's mandatory home forum remain available.
To the extent permitted by law, the beta is supplied as available and without promises beyond these terms. Liability is limited only where and to the extent applicable law permits; fraud, wilful misconduct, death or personal injury, and other non-excludable liability are not excluded.
